Payment and Refund Policies

Payment in Application

  1. Monthly Plans
    • Charges: Billed on the first day of the subscription term and automatically on the same date each subsequent month (“Monthly Pay Date”).
    • Continuation: Monthly billing continues unless canceled via the “Billing” page in the Application.
    • Cancellation: No refunds or credits for prepaid and unused fees if canceled before the Monthly Pay Date. Access to Products continues until the following Monthly Pay Date.
  2. Annual Plans
    • Charges: Billed on the first day of the subscription term and automatically on the same date each subsequent year (“Annual Pay Date”).
    • Continuation: Annual billing continues unless canceled via the “Billing” page in the Application before the Annual Pay Date.
    • Cancellation: No refunds or credits for prepaid and unused fees if canceled during the term. Access to Products continues until the following Annual Pay Date.
    • Fee Increase: Subscription fees may increase by up to 7% on the Annual Pay Date.
  3. Annual Plans with Monthly Payment
    • Charges: Billed on the first day of the subscription term and automatically on the same date each subsequent month.
    • Continuation: Monthly billing continues unless canceled at least thirty days prior to the end of the current subscription term by notifying the account manager or support@gmbbriefcase.com.
    • Cancellation: No refunds or credits for prepaid and unused fees if canceled during the term. All unpaid fees must be paid. Access to Products continues until the end of the term.
    • Fee Increase: Subscription fees may increase by up to 7% on the renewal term start date.

Payment by Invoice

  • Payment Due: Upon receipt of the invoice.
  • Non-Payment: If payment is not received within thirty (30) days, the account may be suspended, losing access to Products.
  • Renewal: Plan renews automatically unless canceled via email to support@gmbbriefcase.com at least thirty (30) days prior to the end of the term.
  • Fee Increase: Subscription fees may increase by up to 7% upon renewal.

Changes to Your Plan

  • Upgrades and Add-Ons: Charged at the current price, prorated for the remaining term. Automatically renew with the existing Plan.
  • Downgrades and Removals: No refunds or credits for unused and prepaid fees. Downgrading may result in loss of content, features, or account capacity.

Credit Card and PayPal Authorization

  • Authorization: By providing payment information, you authorize GMBBriefcase to store and charge your account.
  • Payment Issues: Notice provided via email for expired, declined, or outdated payment methods. Accounts may be suspended until payment is received.

Disputes and Late Payments

  • Disputes: Must be notified in writing before the due date.
  • Late Payments: Subject to a finance charge of 1.5% per month or the highest legal rate, compounded daily. Reimbursement for collection costs, including attorney fees, is required.

Taxes

  • Responsibility: You are responsible for all federal, state, local, and foreign taxes, duties, tariffs, levies, withholdings, and similar assessments, excluding taxes based on GMBBriefcase’s net income.

Cancellation and Termination

Termination by You

  • Voluntary Termination: No refunds for prepaid and unused fees. Unpaid fees become due immediately.
  • For Cause: A prorated refund is available if GMBBriefcase fails to cure a material breach within thirty (30) days of written notice.
  • General Cancellation: Can cancel as provided in the Payment section.

Termination by Us

  • Restriction/Suspension: May restrict functionality or suspend your account for violation of Terms. Notification will be provided unless immediate action is required.
  • Termination Reasons:
    • Violation of Terms
    • Non-payment of fees
    • Subscription period expiration with prior notice
    • Bankruptcy or insolvency
    • Actions causing reputational harm to GMBBriefcase
  • No Refunds: No refunds for prepaid and unused fees. Unpaid fees become due immediately. Fraudulent or illegal activity may be reported to law enforcement.

Post Termination

  • Account Deletion: Account settings and content may be deleted within thirty (30) days. Deleted content cannot be recovered except for content on Third Party Services according to their terms.
